Reason Codes for Suspension/Expulsions
01 Intolerable Behavior-
This reason is used for students that have continuous inappropriate behavior that leads to office referrals. This would indicate that both teacher and administrative time has been spent to deal with this students behavior and the inappropriate behavior has resulted in lost instruction and/or administrative time.

02 General Fighting-
This reason is used for students that have been involved in a fight. This typically means that there were, at least, two individuals involved in the fight. Punches were thrown by both individuals and both very likely received some type of damage in the contact.

03 Assault on Pupil-
This reason is used for students who have made an unlawful, intentional threat or attempt to do bodily harm to a student coupled with the apparent ability to do bodily harm and resulting in the immediate placement of a person in fear of bodily harm.

04 Battery on Pupil-
This reason is used for students who unlawfully intentionally touched or applied force to another student and it was done in a rude, insolent or angry manner.

05 Assault on School Personnel
This reason is used for students who have made an unlawful, intentional threat or attempt to do bodily harm to a staff member coupled with the apparent ability to do bodily harm and resulting in the immediate placement of a person in fear of bodily harm

06 Battery on School Personnel
This reason is used for students who unlawfully intentionally touched or applied force to a staff member and it was done in a rude, insolent or angry manner.

07 Bomb Threat-
This is for the student that causing a false alarm, or causes a false bomb threat that is considered a substantial disruption to the operation of the school.

08 Use of Vulgar and/or Profane Language
Profanity and vulgar language, either swear words or sexually explicit talk is prohibited. A student using this type of language is subject to disciplinary action.

09 Defiance of Authority
Defiance of an order of a teacher, peace officer, school security officer, or any school authority when such disobedience can reasonably be anticipated to result in disorder, disruption, or interference with the operation of any public school or substantial and material impingement upon or invasion of the right so others.

10. Acted to Incite a Disturbance/Disorderly Conduct
Conduct, which causes action that endangers the safety of others or which substantially impinges upon or invades the rights of others at school, on school property or at a school, supervised activity.

11. Destruction of Property
Conduct, which maliciously destroys, or defaces school property, will not be tolerated. It is expected that the student will make restitution as part of the penalty for such action. This type of action can also lead to the student being referred to the police.

12. Kidnapping
The taking of any student or employee by force and against their will is prohibited.

13. Possession and/or Use of Tobacco Products
All students, no matter the age, can not have tobacco products or paraphernalia on school property.

14. NONE
15. Sexually Violent Crimes
This is conduct which brings direct harm to another person that was brought about due to unwelcome sexual advances, requests for sexual favors, and other verbal or physical conduct of a sexual nature such as is listed below:
Rape:
is sexual intercourse with a person who does not consent to the sexual intercourse.
Indecent Liberties:
involves engaging in sexual act(s) with a child under 16 years of age.
Lewd and Lascivious behavior:
is engaging in sexual intercourse, sodomy or other such sexual acts where others may possible be able to observe such acts.
Enticement:
is the inviting, persuading or attempting to persuade a child under 16 years of age to engage in an unlawful sexual act.
Indecent Solicitation:
is the accosting, enticing or soliciting of a child under the age of 16 to commit or submit to an unlawful sexual act.

16. Buying, Selling, Trafficking Legal/Illegal Substances/Felony Drugs
Any student who is buying, selling or delivering controlled/illegal substance or drug paraphernalia is exhibited this type of conduct. Controlled substance is defined as:
A drug or other substance identified under schedules I, II, III, IV or V in 21 U.S.C.812 c. If you desire a copy of the list contact the hearing office.
Illegal drug is defined as:
A controlled substance but does not include such a substance that is legally possessed or used under the supervision of a licensed health-care professional or that is legally possessed or used under any authority under any federal or state law.

17. Use or Possession of Legal/Illegal Substances
Any student who appears to be affected by or whose conduct appears to be altered by the use of drugs or other controlled substances or admits to use or it can be proven the student did use, which could include tobacco for any student under age, or admits same, and/or gives evidence of need for medical attention, shall be considered under the influence of such substances or considered to have used such substances.

18. Use or Possession of Alcohol
Any student who appears to be affected by or whose conduct appears to be altered by the use of alcohol or admits to use or it can be proven the student did use, and/or gives evidence of need for medical attention, shall be considered under the influence of such substances or considered to have used such substances.

19. Possession and/or Use of a Weapon
Any student who is found to have brought, handled, transmitted or to have been in possession of a weapon, as defined below, on school property, or at a school supervised activity shall be considered to be in violation of school district rules and/or policies.
Weapon is defined to mean:
any weapon which will or is designed to or may readily be converted to expel a projectile by the action of an explosive
the frame or receiver of any weapon describe in the preceding example
any firearm muffler or firearm silencer
any explosive, incendiary, or poison gas (A) bomb, (B) grenade, (C) rocket having propellant charge of more than four ounces, (D) missile having an explosive or incendiary charge of more than ¼ ounce (E) mine, or (F) similar device
any weapon which will, or which may be readily converted to, expel a projectile by the action of an explosive or other propellant, and which has any barrel with a bore of more than ½ inch in diameter
any combination of parts either designed or intended for use in converting any device into any destructive device described in the two immediately preceding examples, and from which a destructive device may be readily assembled any bludgeon, sandclub, metal knuckles or throwing star any knife, commonly referred to as a switch-blade, which has a blade that opens automatically by hand pressure applied to a button, spring or other device in the handle of the knife, or any knife having a blade that opens or falls or is ejected into position by the force of gravity or by an outward, downward, or centrifugal thrust or movement i. e. butterfly knife
replica firearm, which means, realistic replica of a firearm that, because of the appearance of such replica firearm, could place a person in fear of bodily harm
any single bladed article that could cut or stab, or any article that is commonly used or is designed to inflict bodily harm
any article that is not per se a weapon which is used to cause a person to be placed in fear of bodily harm, i. e. laser pens, belts, combs, pencils, files, compasses, scissors etc.

20. Threats/Intimidation
Threats/Intimidation or assault means the unlawful, intentional threat or attempt to do bodily harm to the person of another coupled with the apparent ability to do bodily harm and resulting in the immediate placement of a person in fear of bodily harm. No physical contact is necessary. Typically involves a threat to cause violence or disruption to the order of a school or classroom.

21. Theft/Stealing
Student has taken another individual’s personal property or property that belongs to the school district without the permission of another individual or person who is responsible for the property of the district

22. Extortion
This is defined as obtaining something of value from an unwilling person by either physical force or intimidation.

23. Felony Theft
Student has taken another individual’s personal property or property that belongs to the school district without the permission of another individual or person who is responsible for the property of the district
Such property was valued at an amount of $500.00 or greater.

24. Burglary
Burglary is knowingly and without authority of the owner entering into or remaining within any building, portable unit, other structure or motorized vehicle with intent to commit a felony or theft therein.

25. Aggravated Burglary
Burglary is knowingly and without authority of the owner entering into or remaining within any building, portable unit, other structure or motorized vehicle with intent to commit a felony or theft therein when a human being is present in said vehicle or structure.

26. Aggravated Robbery
Aggravated Robbery is the taking of property from the person or presence of another by threat of bodily harm to the person or by force, or who inflicts bodily harm upon any person with a weapon in the course of such a robbery

27. Fire/General
The deliberate starting of a fire for any reason on school property, without the prior consent of administration may be a general fire when it can not be identified as arson or aggravated arson

28. Arson
Arson is any willful or malicious burning or attempt to burn, with or without intent to defraud, any building or buildings or motorized vehicles or any personal property of another.

29. Aggravated Arson
Arson is any willful or malicious burning or attempt to burn, with or without intent to defraud, any building or buildings or motorized vehicles or any personal property of another when a human being is present.

30. Other School Rules
Often violations of student handbooks or other printed rules within an individual building. Intolerable behavior is an example of what would fall under this area.
Some examples, not intended to inclusive:
Intolerable behavior relates to multiple offenses at the same site during the same school year.
Destruction of property refers to damage to property other than by fire or explosive, that ends up destroying the property or substantially impairs the use of said property.
Vandalism refers to the willful injury, damaging, mutilating, or defacing of property.
31. Other Harassment
Any form of persistent intimidating teasing, pestering/annoying gestures or written/verbal physical acts that create a hostile, threatening or abusive educational environment.

32. Bullying
Any intentional gesture or written, verbal or physical act or threat that that is sufficiently severe, persistent or pervasive that is creates an intimidating, threatening, or abusive education environment for a student or staff member that a reasonable person under the circumstances know or should know, will have the effect of:
Physically or mentally harming the student or staff member. Damaging a student’s or staff member’s property. Placing a student or staff member in reasonable fear of harm; and Placing a student or staff member in reasonable fear of damage to the student’s or staff members property; or Any other form of intimidation or harassment prohibited in policies adopted by the board of education pursuant to this new bullying law or adopted under the school board’s home rule authority as se forth in K.S.A. 728205.
Cyberbullying means: Bullying by use of any electronic communication device through means including, but not limited to, e-mail, instant messaging, text messaging, blogs, mobile phones, pagers, online games and websites.

33. Sexual Harassment
This is conduct that is defined as unwelcome sexual advances, requests for sexual favors.
34. Sexual Assault
Verbal or physical conduct of a sexual nature.
